The hard question

If one spouse reduces paid work for the family, when should you discuss their financial protection?

A postnup is not a prenup with a different date

A prenup is made before marriage; a postnup is made during marriage. Spouses may already have acquired property and rights. Do not simply change the date on a premarital template.

New York §236 Part B(3) expressly addresses agreements before or during marriage and prescribes writing, signing, and acknowledgment requirements. This is one state’s example, not nationwide instructions.

Not every family agreement is a postnup

Budget plans, household responsibilities, and parenting notes can support discussion. Do not assume they are enforceable postnups. Our AI conversation draft is not a marital contract either.

Separation agreements, amendments to existing prenups, and estate planning are distinct legal tasks. Florida §732.702 separately addresses waivers of spousal estate rights and financial disclosure after marriage; this is not a general rule for all divorce terms.

What you can prepare yourself

Discuss what changed: a child, a career break, a home purchase, a business, debts, or relocation. Each person can record preferences and questions without signing our worksheets as an agreement.

Organize assets, obligations, existing agreements, and questions about each person’s contributions offline. Share records securely with counsel, not through this site. Your own independent lawyer can assess consequences for you.

  • What rights exist already, and what changes are proposed?
  • How could we protect someone earning less because of family care?
  • Can either person freely decline or ask for time?
  • What other documents or specialists may be needed?

Costs and limits

Do not treat prenup pricing as a postnup quote. We do not publish a verified universal fee for postmarital agreements. Request separate quotes for drafting, independent review for each spouse, negotiation, asset valuation, translation, and revisions.

An agreement cannot guarantee a lasting marriage or resolve a conflict by itself. Do not demand signatures by threatening access to money, housing, or documents. If there are threats, seek independent help first rather than negotiate through a website form.
